Soceal Terms of Use
These Terms of Use (the "Terms") set out the conditions under which users may use "Soceal" (the "App"). By using the App, you are deemed to have agreed to these Terms.
Article 1 (Purpose)
The App provides functionality to temporarily download content (images and videos) posted on Instagram and X (formerly Twitter), for the purpose of allowing users to appropriately re-share such content (the "Repost") on their own feeds or stories. The App prohibits any download or use for purposes other than reposting, and prohibits use that involves secondary use of content without permission from the original poster.
Article 2 (Prohibited Acts)
Users must not engage in any of the following acts when using the App:
- Copyright infringement: Reposting content without permission from the copyright holder, or using it commercially.
- Violations of public order and morals: Reposting content that violates public order or morals.
- Violations of platform terms: Any act that violates the official terms of service of Instagram or X.
- Infringement of others' rights: Infringement of others' rights of publicity, privacy, or reputation.
Article 3 (Disclaimer)
- Content rights: The copyright in content reposted via the App belongs to the original poster. The App does not guarantee the legality of any content.
- Transfer of responsibility: The developer and operator of the App bear no responsibility for disputes or damages between users and third parties (including original posters and the operators of Instagram and X) arising from use of the App.
- Service interruptions: The functionality of the App may be temporarily or permanently suspended due to specification changes by Instagram or X, or other reasons.
- Account restrictions: If a user's Instagram or X account is restricted (shadowban, feature lockout, etc.) as a result of using the App, the developer and operator bear no responsibility.
Article 4 (User Responsibility)
- Rights verification: Users are responsible for obtaining permission from the copyright holder of the content before reposting it.
- Credit display: When reposting, users must always credit the original poster by their username and perform the re-share in an appropriate manner.
Article 5 (Changes to the Terms)
The operator may change these Terms from time to time without prior notice to users. The amended Terms shall take effect from the time they are posted in the App.
Article 6 (Governing Law and Jurisdiction)
- The interpretation of these Terms shall be governed by the laws of Japan.
- Any disputes related to the App shall be subject to the exclusive jurisdiction of the courts in Tokyo, Japan, as the court of first instance.
